1) General Provisions
This Refund Policy governs the procedure for refunds for services and digital products purchased remotely (through the website) from Growth Marketing Agency DOO, Montenegro (hereinafter referred to as the “Company”).

If the buyer is a consumer, meaning a natural person acting outside their trade, business, or professional activity, the provisions of the Montenegro Consumer Protection Law shall apply.

For purchases made by legal entities and sole proprietors, refund terms shall be determined by the contract and/or invoice.

2) What is considered “services” and “digital products”
Services include online consultations, individual sessions, support services, online broadcasts/events, and other work/services provided by the Company.

Digital products (digital content) include video courses, recordings, access to a personal account/platform, and materials for viewing or downloading, provided that such content is not supplied on a tangible medium, for example, not on a physical carrier.

3) Right of unilateral withdrawal (14 days) and full refund
A consumer has the right to withdraw from a distance contract within 14 days without stating any reason, except in cases expressly provided for by law.

The 14-day period is calculated as follows:

for services and for contracts whose subject is digital content not supplied on a tangible medium, the period begins on the date the contract is concluded, meaning the date of purchase/order placement.

If the withdrawal is validly exercised within this period, the Company shall refund all amounts paid under the contract within up to 14 days from the date of receipt of the withdrawal notice.

4) How to request a refund (notice of withdrawal)
To exercise the right of withdrawal, the consumer must send the Company a notice before the 14-day period expires:

Important: the burden of proving the fact and date of sending the notice lies with the consumer. Please keep your e-mail or proof of submission.

Recommended e-mail subject line: “Refund request / Unilateral withdrawal”

Order number and payment date

Name of the service/course

The following statement: “I request termination of the contract and a refund of the amount paid.”

5) Timeframe and method of refund
The refund shall be made no later than 14 days from the date of receipt of the withdrawal notice.

The refund shall be made using the same payment method that was used for the original payment, unless the consumer has expressly agreed otherwise. No additional fee shall be charged by the Company for the refund itself.

Any bank or payment system fees that may be charged by the consumer’s bank upon receipt of funds are outside the Company’s control.

6) Special rules for services (partial performance, early start at the client’s request)
If the consumer expressly requested that the service begin before the expiry of the 14-day period and then withdraws from the contract, the consumer must pay an amount proportionate to the services actually provided up to the moment the withdrawal notice was given.

If the consumer did not request an early start of the service, or if the mandatory notices were not provided to the extent required by law, the rule on proportionate payment may not apply, within the limits established by law.

7) Special rules for video courses and digital content
The 14-day right of withdrawal also applies to contracts for digital content not supplied on a tangible medium, and the period runs from the date of purchase.

However, the law provides for an exception:

the consumer does not have the right of unilateral withdrawal if:

the supply of digital content, including access, viewing, or downloading, has begun; and

this began with the consumer’s prior express consent; and

the consumer acknowledged that by giving such consent, they lose the right of unilateral withdrawal.

If a refund is lawfully requested and must be granted, access to the course/materials may be terminated as of the refund date.

8) If the consumer was not informed of the right of withdrawal
If the Company did not inform the consumer of the right of unilateral withdrawal, the right of withdrawal expires 12 months after the end of the standard 14-day withdrawal period. If such notice is provided within those 12 months, the right expires 14 days from the date the consumer receives the notice.
